NOTICE ABOUT THE PROCESSING OF PERSONAL DATA

This information describes the processing of personal data of Fornasetti customers who decide to use Whatsapp to get in touch with us (the "Customers").

1. DATA CONTROLLER

For the purposes of this Notice, the Data Controller is Fornasettiana Srl, with registered office in Milan, Via Senato 2, tax code and VAT number 06557150965 ("FORNASETTI").

2. DATA COLLECTED

2.1 Data provided by Users

The personal data collected by the Data Controller is data communicated by Customers through the use of the WhatsApp Business app, automatically, through simple usage, or via an explicit request from the Customers, for the purpose of a commercial transaction.
The data collected includes Customers' identification and contact data (e.g. name and surname, email address, telephone number, physical address).

3. PURPOSES OF DATA PROCESSING

The personal data of Users communicated to the Data Controller via the Whatsapp Business ("Data") may be processed for the following purposes.

3.1 Instant messaging - Marketing communications

The data collected will be processed for the use of Instant Messaging to send commercial communications of an informative and educational nature about FORNASETTI news and activities, including possible invitations to initiatives, events and/or conferences organised and/or sponsored by FORNASETTI, also in collaboration with third parties.
The User can cancel their subscription to the Instant messaging service at any time by sending a specific communication to FORNASETTI at the addresses specified in point 7 below.
The legal basis of this processing is the express consent of the Customer.

3.2. Instant messaging - Response to Customer requests

The data collected will be processed for the use of Instant Messagingto send answers, communications, information and clarifications to questions received by the Data Controller from Customers.
The User can cancel their subscription to the Instant messaging service at any time by sending a specific communication to FORNASETTI at the addresses specified in point 7 below.
The legal basis of this processing is the execution of a contractual (or pre-contractual) relationship between the Customer and the Data Controller.

4. PROCESSING METHODS

The Data will be processed using manual and automated tools by personnel and partners of FORNASETTI and/or companies expressly appointed as data controllers, and to whom FORNASETTI has issued detailed operating instructions with particular reference to the adoption of appropriate measures for technical and organisational security.
One of these companies is Immaginazione S.r.l., with registered office in Milan, Via Antonio Bazzini 14, tax code and VAT number 09676180152, entrusted by FORNASETTI, among other things, with the activities of sending its newsletters.
The complete list of Data processors is kept at the Data Controller's office and is available on request, which can be forwarded to the addresses specified in point 7 below.

5. DATA RECIPIENTS

The Data will be communicated and transferred to the categories of subjects specified where the purposes and methods processing are described.
In any case, the Data will not be disclosed.

6. RETENTION PERIOD

The personal data collected and processed by FORNASETTI, for the services defined in point 3.1., i.e. for commercial purposes, will be kept for a period of 24 (twenty-four) months from the last contact with the Customer.
The personal data collected and processed by FORNASETTI, for the services defined in point 3.2., i.e. for contractual purposes, will be kept for a period of 36 (thirty-six) months from the last contact with the Customer.
The Data may be stored for longer periods if necessary to comply with legal obligations, or for the protection of FORNASETTI's rights, until the expiry of the relevant period of limitation.

7. USER'S RIGHTS AND CONTACT DATA

The User may, at any time and within the limits in which the rights are applicable: (I) obtain confirmation of the existence or not of personal data concerning them; (II) request access to their personal data; (III) request the rectification, deletion or limitation of the processing of personal data; (IV) oppose processing, or withdraw consent to processing, without prejudice to the lawfulness of the processing on the basis of the consent given prior to the revocation; (V) receive, in a structured format, commonly used and readable by an automatic device, the personal data concerning them provided to FORNASETTI, and request that such data be transmitted to another data controller (right to portability of personal data); (VI) lodge a complaint with the Supervisory Authority for the protection of their personal data, or appeal to the competent judicial authority.
